Environment Secretary Vinyard’s Current Claims Contradict His Previous Filings</span></b><o:p></o:p></span></div>

Environmental Protection Agency (EPA) is trying to decide which Herschel
Vinyard to believe – the one who claimed his expertise in handling pollution
permits as his chief qualification to serve as Florida’s top environmental
official or the one who is now alleging, through a state lawyer, he had nothing
to do with permits. At stake is whether he will be barred from handling
water pollution matters as the result of a federal conflict-of-interest
complaint filed by Public Employees for Environmental Responsibility (PEER) and
the Florida Clean Water Network.<br />
<br />
The groups today released the latest correspondence from EPA questioning why
information on Vinyard’s résumé and state job application, and even the
Governor’s press release announcing his appointment as Secretary of the Florida
Department of Environmental Protection (DEP), are all incorrect, as Vinyard now
declares. The April 27, 2012 letter from EPA Regional Counsel Mary Wilkes
asks Thomas Beason, the General Counsel for DEP, which Vinyard oversees, to
“explain the apparent discrepancy between the assertion in your letter” that
Vinyard was not really employed by the company he said he worked for in state
filings or doing work he once bragged about but now disclaims.<span class="apple-converted-space"> </span><br />
<br />
The federal Clean Water Act forbids appointment of any state decision-maker on
pollution discharge permits in federal water quality programs who “has during
the previous two years received a significant portion of his income directly or
indirectly from permit holders or applicants for a permit” (emphasis
added). Vinyard represented himself as director of operations for BAE
Systems Southeast Shipyards where he was responsible for its wastewater permits
and other regulatory affairs. He also chaired the Shipbuilders Council of
America, representing 40 companies operating 100 shipyards.<br />
<br />
“Secretary Vinyard should stop wasting state resources playing peek-a-boo with
the EPA. His ploy that he is not in clear violation of federal law
because he lied on his job application is just plain absurd,” stated Florida
PEER Director Jerry Phillips, a former DEP enforcement attorney, noting that
Governor Scott should fire him if he falsified his application. “By using state
lawyers to dissemble on his behalf, Mr. Vinyard is only making a bad situation
worse.”<br />
<br />
The next move may aggravate the jeopardy for Secretary Vineyard, as making
false official statements to a federal agency is a crime which could result in
loss of office and imprisonment, sanctions far more serious than those he now
faces. Unfortunately, EPA has not moved swiftly to resolve the February
2011 complaint, despite one promise last November to render a final decision
“within two weeks.”<span class="apple-converted-space"> </span><br />

if not all of his decisions over the past 15 months have reflected a
pro-polluter bias,” said Linda Young, Director of the Florida Clean Water
Network. “As a regular user of our waters I am personally so unimpressed with
our state and federal government’s level of concern over Vinyard’s disregard
for the law that I think a citizens’ arrest is now in order.”</b></span><o:p></o:p></span><br />

now being constructed in the Fort McCoy area within the Springshed. This
project includes a projected 30,000 head of cattle, a slaughterhouse, 135 large
diameter wells, and a pending water permit (CUP-consumptive use permit) for
13.27 MILLION GALLONS OF WATER PER DAY. Water from OUR aquifer!</span><o:p></o:p><br />

a very large group of concerned citizens gathered together last night to find
out more about what is happening to our beautiful Silver Springs. He has
founded a group called the Silver Springs Alliance, Inc. to raise awareness
about our future water resources and saving the springs for future
generations. As you probably know from past information I have sent you
many of our springs, lakes , rivers and wetlands are in very poor health due to
a low Floridan Aquifer that is caused by the current drought and the large
amount of pumping from the aquifer. There is a new consumptive use permit
request from Adena Ranch which is only about 7 miles from Silver Springs to
pump over 13 mgd of water from the upper Floridan Aquifer. Silver Springs
is already in serious decline and if this permit goes through it will probably
be the nail in the coffin for the Springs. The CUP will also severely
impact the Ocklawaha and Silver River. We just cannot stand by and let
this happen and everyone needs to support the Silver Springs Alliance in

water is more important than ever, and I am requesting your help. Many of
you have told me that you see people irrigating their yards at all times of the
day and several days a week and don’t know what to do about it. Some of
you have even taken the extra step to try to educate your neighbors about
water restrictions, and they pay you no heed. I have heard people say that
they think there is no way to enforce the restrictions mandated by the St.
Johns River Water Management District. This is not true as they do patrol
the District and will go out to an address that is reported to be watering
contrary to the mandated restrictions. </span><br />
<span style="font-family: "Arial","sans-serif";">All you have to do is report the
address to the number below and here is what happens: </span> <br />
<ol>
<li><span style="font-family: "Arial","sans-serif";">A patrol goes out to the residence
and tries to educate the folks that are reported about the restrictions and
gives them a packet about water conservation.</span></li>
<li><span style="font-family: "Arial","sans-serif";">Then they are in the District's
computer, and they will be checked again infrequently. If they are
reported again or caught by the patrol, they will be given a warning.</span> </li>
<li><span style="font-family: "Arial","sans-serif";">If the party is reported or caught
a third time, they can be slapped with a fine. </span></li>
</ol>
<span style="font-family: "Arial","sans-serif";">Agricultural watering and
hand watering are not covered by the landscape irrigation restrictions.
The report can be anonymous.</span><o:p></o:p><br />

<span style="font-family: "Arial","sans-serif";">Nobody wants to be a
snitch, but the fact of the matter is that people who wantonly waste water and
will not do what they should do voluntarily need to be subjected to some kind
of penalty. They are stealing your water. </span> <span style="font-family: "Arial","sans-serif";">Not only are our lakes disappearing
from the face of the earth, but we also have folks in our area on limited incomes who have</span>
<span style="font-family: "Arial","sans-serif";">had</span> <span style="font-family: "Arial","sans-serif";">to pay over $5000 to have their pumps
replaced and deeper wells dug because the aquifer is so low. It does not
matter if you live inside the city limits or in the country, if you live in the
St. Johns River Water Management District you are bound by these rules.
If you live in the Suwannee District, please contact them and find out what
recourse you have for water abusers. </span><br />
<br />
<span style="font-family: "Arial","sans-serif";">I realize some people ask why they
should have to do anything when big industries are using so much water. I
say all the more reason to save every drop we can. How can we ask them to
reduce their use if we will not? Charity starts at home, and we all have a
straw in the aquifer. Please observe the restrictions listed below and
help educate others about them. It is up to us to save the aquifer that
supports all of the lakes, rivers, springs and wetlands of North Florida.
